Please read these Terms and Conditions carefully before using the Bunyan Engineering Services website or requesting any of our services. Your use of the website or request for our services constitutes your agreement to be bound by these Terms.
1. Definitions and General Provisions
The Company: Refers to Bunyan Engineering Services, a company registered and licensed in the Sultanate of Oman.
Services: Refers to all services provided by the Company, including but not limited to: Engineering Claims Management, FIDIC contract preparation, Feasibility Studies, Engineering Designs, and Third-Party Services.
The Client: Refers to any person or entity (individual, company, or developer) that requests or benefits from the Company's services.
The Website: Refers to the Company's official website.
2. Scope of Services and Obligations
Nature of Services: The Company provides consulting and engineering services with the utmost professionalism and care, in accordance with international best engineering practices and the standards adopted in the Sultanate of Oman.
Contractual Agreement: The contractual relationship for services commences under a separate service agreement or contract signed by both parties (the Company and the Client). This agreement specifies the scope of work, timelines, fees, and payment terms for the requested service.
Legal Advice: The Company provides its services from an engineering, managerial, and contractual perspective (such as FIDIC contracts) and does not constitute a substitute for specialized legal advice from a licensed attorney.
3. Fees and Payment
Fee Determination: Fees for each service are determined by a separate quotation provided to the Client, which becomes binding upon mutual agreement.
Payment Terms: Payment terms (advances, interim payments, and final payments) are specified in the signed contract or service agreement.
Late Payment: The Company reserves the right to suspend or cease providing services if the Client fails to settle outstanding payments by the agreed-upon dates.
4. Intellectual Property and Confidentiality
Intellectual Property (IP): All blueprints, designs, reports (including Feasibility Studies and BIM reports), and models produced by the Company remain the intellectual property of the Company until the full agreed-upon amount under the contract is paid. After payment, the rights to use the work are transferred to the Client according to the contract terms.
Confidentiality: The Company undertakes to maintain the confidentiality of all information and documentation provided by the Client and not to disclose it to any third party without prior written consent, except as required by law or joint work (such as submitting licenses to government authorities).
5. Limitation of Liability and Warranties
Limitation of Liability: To the maximum extent permitted by law, the Company shall not be liable for any indirect, consequential, or incidental losses (including loss of profits or revenue) that may arise from the use of or inability to use our services.
Project Management: In integrated project management services, the Company acts as a Consultant and Owner's Representative. The Company is exempt from liability for execution errors that fall under the contractors' responsibility, while committed to exercising due professional care in supervising execution quality.
6. Compensation and Dispute Resolution
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Sultanate of Oman.
Dispute Resolution: In the event of any dispute, both parties agree to make their best efforts to resolve the dispute amicably. If an amicable resolution is not possible, the dispute shall be referred to the competent courts in the Sultanate of Oman (Muscat) for adjudication.
7. Amendment of Terms
The Company reserves the right to amend these Terms and Conditions at any time. Amendments will be published on this page and become effective immediately upon posting. Your continued use of the website after the amendments are posted constitutes your acceptance of the revised Terms.
